Manufacturing Compliance in UAE Federal: Complete Guide

Manufacturing enforcement in the UAE is documentary, so a company that reconstructs the certificate, the calibration log, the waste transfer note and the batch record afterwards tends to lose on the record rather than on the facts.

A UAE factory is licensed twice: by the emirate or free zone where it stands, and again on the federal industrial register kept by the Ministry of Industry and Advanced Technology. The gap surfaces when a tender, an incentive or an origin certificate turns on the federal record. Two layers of permission, and they are not the same permission

A factory in the UAE is licensed twice. The emirate where the plant physically sits issues the trade or industrial licence that lets the company exist and trade — the Department of Economy and Tourism in Dubai, the Abu Dhabi Registration Authority in Abu Dhabi, or the relevant free zone authority. Separately, at federal level, the Ministry of Industry and Advanced Technology (MoIAT) maintains the industrial register in which manufacturing operations are recorded and through which national industrial policy is applied.

Companies that assume the emirate licence is the whole story discover the gap late, usually when they apply for something that depends on federal industrial registration: a government tender, an incentive scheme, an origin certificate for export, or a customs treatment. The two layers ask for overlapping information but they answer different questions, and both have to be kept current when the plant changes what it makes, how much of it, or where.

What has to be true about the product

Standardisation, metrology and conformity assessment for the UAE sit with MoIAT. For regulated product categories, a manufacturer or importer obtains a certificate of conformity under the Emirates Conformity Assessment Scheme (ECAS) before the goods may be placed on the market; the Emirates Quality Mark is the voluntary step above that, awarded against a standard together with an assessment of the factory itself. Separate national schemes apply to halal products, and product-specific regulators sit on top for medicines, medical devices, food, and telecommunications equipment.

Three practical consequences follow:

  • Conformity is tied to a defined product and a defined production process. Changing a supplier, a formulation, or a component can put the certificate outside its own scope.
  • Testing has to be done by a laboratory the scheme recognises. A report from an unaccredited lab is not a shortcut.
  • Labelling in Arabic, and the content of that labelling, is part of compliance, not marketing. It is one of the most common reasons goods are held or withdrawn.

Metrology, which manufacturers routinely underestimate

If the product is sold by weight, volume or count, the instruments that determine that quantity are regulated, as are the declarations printed on the pack. Calibration records, verified instruments, and net-content declarations that match reality are checked in the field. Enforcement here is unglamorous and constant, and it produces more findings for most factories than the headline product standards do.

The workforce side of a factory licence

Employment across the UAE is governed by Federal Decree-Law No. 33 of 2021, which replaced Federal Law No. 8 of 1980, and is administered for mainland employers by the Ministry of Human Resources and Emiratisation. For a manufacturing employer the recurring exposures are documentary rather than exotic: every worker on a written contract registered with the ministry, wages paid through the wage protection system, the job actually performed matching the one on the permit, and end-of-service entitlements accrued rather than discovered at termination.

Occupational health and safety, worker accommodation and transport are inspected by the labour and municipal authorities together, and a serious injury will draw all of them at once. The company's own incident records are the first thing asked for, and the quality of those records tends to set the tone for everything that follows.

Environmental permits and hazardous materials

The Ministry of Climate Change and Environment sets federal environmental policy, while the operating permits that a plant actually holds — emissions, effluent, waste streams, storage and handling of hazardous substances — are issued and inspected locally by the environment agency or municipality of the emirate. Waste must be transferred to a licensed contractor and evidenced; the obligation does not end at the factory gate, and a contractor's failure has been treated as the generator's problem.

What happens when a product goes wrong

Manufacturers are exposed on two fronts at once. Contractually, supply arrangements are governed by Federal Decree-Law No. 50 of 2022 on commercial transactions, which replaced Federal Law No. 18 of 1993, and by whatever the distribution agreement says about warranties, defect notification and indemnities. Separately, the federal consumer protection regime gives the Ministry of Economy the power to require corrective action, including withdrawal of goods from the market, regardless of how the contract allocates risk between the manufacturer and its distributor.

That second track is why a recall procedure should exist before it is needed: batch traceability that actually works, a named decision-maker, a line to the regulator, and agreement with distributors about who bears the cost. Firms that improvise a recall usually make statements early that harm them in the commercial disputes that follow with their own supply chain.

Tax, and the end of the "tax-free" assumption

Corporate tax under Federal Decree-Law No. 47 of 2022 applies for financial years starting on or after 1 June 2023, at 0% on taxable income up to AED 375,000 and 9% above that. VAT is charged at 5% under Federal Decree-Law No. 8 of 2017 as amended by Federal Decree-Law No. 18 of 2022. For a manufacturer the practical work is in the records: transfer pricing where goods or services move between related entities in a group, and import VAT treatment on inputs.

Where to put the effort

Most manufacturing enforcement in the UAE is documentary. The authority asks for the certificate, the calibration log, the waste transfer note, the employment contract, the batch record. Companies that keep those in order deal with inspections as routine; companies that reconstruct them afterwards spend far more, and often lose the argument on the record alone rather than on the underlying facts.
